Can I disinherit my children?

Have you been watching your soap operas lately? Are you wondering if the wealthy heiress can really disinherit her own child. Well you're in luck . . .


Most states allow you to disinherit an adult child within your Last Will & Testament for no reason at all. Pretty surprising, right? Obviously, you do not want to make this decision lightly.


Minor children are a different story. Leaving your child out of your Will will likely lead to the Court interpreting your minor child into the will. In some states you may not be able to disinherit an adult child if they are incapacitated. An alternative may be to set up a trust for an adult child to receive disbursements periodically.
